This Math Mechanixs Software Agreement ("Agreement") for the

Math Mechanixs software, as modified, added, or deleted in Math Mechanixs

Software's sole discretion from time to time, is your proof of

This Math Mechanixs Software Agreement ("Agreement") for the

Math Mechanixs software, as modified, added, or deleted in Math Mechanixs

Software's sole discretion from time to time, is your proof of

license. An electronic copy of this Agreement has also been

provided to you upon installation of the Software and my be viewed

at any time through the Math Mechanixs "About" dialog box.

1. GRANT AND TERM OF LICENSE.

Subject to your compliance with the terms of this Agreement,

Math Mechanixs Software grants to you a personal, nonexclusive,

right to install and use the Software and receive the Information

solely for your lawful personal use. The following terms apply to

the respective versions of Math Mechanixs. Version information can

be obtained from Math Mechanixs by selecting the "About Math Mechanixs"

menu item from the "Help" menu.

BETA, DEMO AND FREEWARE VERSIONS: The Software may be freely

distributed. You are free to make as many copies of the software

and associated documentation as you wish, give exact copies of the

original software version to anyone, and distribute the software

and documentation in its unmodified form via electronic means.

You are specifically prohibited from charging, or requesting

donations, for any such copies, however made. You are prohibited

from distributing the software and/or documentation with other

products (commercial or otherwise) without prior written

permission from Math Mechanixs, LLC. The software may be

installed on (a) all networked and non-networked computers

controlled by you or other individuals and on workstations used

by you and others. (b) a network server provided that each

individual having access to the server and who intend to use

Math Mechanixs read and comply with this license agreement.

PROFESSIONAL VERSIONS: The Software may be installed only on

(a) non-networked computers controlled by you only or a single

workstation used by multiple people but not both. (b) a network

server provided that you have obtained individual licenses for

the software covering all workstations that will access the

software through the network. For example, if 8 different

workstations will access Math Mechanixs on the network, each

workstation must have its own Math Mechanixs license, regardless of

whether they use Math Mechanixs at different times or concurrently.

The right to use the Software is not transferable.

This Agreement and the license granted in it shall continue until

Math Mechanixs Software announces its termination, and will

terminate automatically if you fail to comply with the limitations

described in this Agreement. Upon any termination, or if you

should give up your personal use and control of the computers on

which the Software is installed, you agree to destroy all copies

of the Software and the Information and any related materials in

any form.

2. COPYRIGHT.

The Math Mechanixs Software is owned by Math Mechanixs, LLC. or its

licensors and is protected by United States copyright laws and

international treaty provisions. Therefore, you must treat the

Software like any other copyrighted material (e.g. a book or

musical recording) except that you may make one copy of the

Software solely for backup purposes which includes all copyright

and trademark notices. You are not permitted to copy the Software

for archival purposes.

3.OTHER RIGHTS.

The Software shall be considered confidential information of

Math Mechanixs, LLC. or its licensors and shall not be disclosed

by you to any third party who has not agreed to the terms of this

Agreement in the manner specified by Math Mechanixs, LLC. You

may not modify, translate, reverse engineer, decompile,

disassemble or create derivative works based on the Software, or

remove any proprietary notices or labels it contains. All

applicable rights to patents, copyrights, trademarks and trade

secrets in the Software or any modifications to it shall be and

remain in Math Mechanixs Software or its licensors.

6. NO WARRANTIES OR LIABILITIES.

(a) PRODUCTS. You expressly acknowledge and agree that use of

the Software is AT YOUR OWN RISK and that the Software is

provided "AS IS" without any warranties or conditions whatsoever.

(b) Math Mechanixs, LLC., AND ALL RESPECTIVE AFFILIATES, AGENTS,

LICENSEES AND LICENSORS: (i) HEREBY DISCLAIM ANY EXPRESS OR

IMPLIED WARRANTIES AS TO THE ACCURACY OF THE SOFTWARE,

COMPLETENESS OF THE SOFTWARE, OPERATION OF THE SOFTWARE,

FITNESS FOR THE PARTICULAR PURPOSE OF THE SOFTWARE, OR THAT THE

RESULTS AND INFORMATION WILL BE ERROR-FREE; (ii) SHALL IN NO

EVENT BE LIABLE TO YOU THE USER OR ANYONE ELSE FOR ANY

INACCURACY, ERROR OR OMISSION IN, LOSS, INJURY OR DAMAGE CAUSED

IN WHOLE OR PART BY, FAILURES OR INACURACIES IN THE INFORMATION

GENERATED BY THE SOFTWARE. (iii) SHALL IN NO EVENT BE LIABLE TO

YOU OR ANYONE ELSE FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL

DAMAGES, INCLUDING BUT NOT LIMITED TO ANY SYSTEM OR COMPONENT

DESIGN FAILURES, LOST PROFITS OR TRADING LOSSES ARISING OUT OF OR

RELATING TO THE USE OF THE SOFTWARE, INABILITY TO USE THE

SOFTWARE, INFORMATION GENERATED BY THE SOFTWARE OR ANY DECISION

MADE OR ACTION TAKEN BY YOU IN RELIANCE ON INFORMATION, EVEN IF

ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(c) THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE

SOFTWARE AND THE INFORMATION GENERATED BY THE SOFTWARE IS WITH

YOU. GOOD DATA PROCESSING PROCEDURE DICTATES THAT ANY PROGRAM BE

THOROUGHLY TESTED WITH NON-CRITICAL DATA BEFORE RELYING ON IT. IF

THE SOFTWARE SHOULD PROVE DEFECTIVE, YOU (AND NOT MATH MECHANIXS

LLC., THE PROGRAMERS, THE AGENTS, LICENSEES AND LICENSORS)

ASSUME ALL COSTS OF SERVICING, REPAIR OR CORRECTION OF SUCH

DEFECTS.

(d) SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION

OF WARRANTIES, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE

LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

6. U.S. GOVERNMENT RIGHTS.

If you are acquiring the Software on behalf of any part of the

United States Government, the following provisions apply. The

Software is deemed to be "commercial software", pursuant to

DFAR Section 227.7202 and FAR 12.212, as applicable. Any use,

modification, reproduction, release, performance, display or

disclosure of the Software (including the related documentation)

by the U.S. Government or any of its agencies shall be governed

solely by the terms of this Agreement and shall be prohibited

except to the extent expressly permitted by the terms of this

Agreement.

7. CHANGED TERMS.

Math Mechanixs, LLC. shall have the right at any time to change

the terms of this Agreement or require new terms and to change,

impose conditions on or discontinue any aspect or feature of the

Software. Such changes shall be effective immediately upon

notification by any means which give you actual knowledge of

them or upon posting of such terms on the Software, and any use

by you of the Software and receipt of the Information after such

notice shall be deemed acceptance of them by you.

8. GENERAL.

This Agreement is governed by the laws of the State of New

Hampshire, without reference to conflict of laws principles.

This Agreement is the entire agreement between Math Mechanixs,

LLC. and you and supersedes any other communications or

advertising with respect to the Software. If any provision of

this Agreement is held unenforceable, that provision shall

be enforced to the maximum extent permissible so as to give

effect the intent of the parties, and the remainder of this

Agreement shall continue in full force and effect. The headings

used in this Agreement are for convenience only, and shall not

be given any legal import. Any item or service furnished by

Math Mechanixs Software, or its affiliates, agents, licensees and

licensors in furtherance of this Agreement, although not

specifically identified in it, shall nevertheless be covered by

this Agreement unless specifically covered by some other written

or electronic agreement accepted by you and an authorized

representative of Math Mechanixs Software or such other party as the

case may be. You agree to comply with all U.S., foreign and local

laws and regulations which apply to your use of the Software and

the Information including without limitation, export control laws

and regulations.

Simple graphing

I used this program to plot very simple data for a chemistry lab. The data was extremely easy to enter in and the graphs easy to manipulate. This is my only experience with the program, but it was helpful.
